Terms & Conditions

1 Introduction
These Terms & Conditions govern the use of the website and the booking of tour packages, hotel accommodation, transportation, sightseeing and other travel-related services arranged or facilitated by The Route Holidays.
For the purpose of these Terms:
- “The Route Holidays”, “Company”, “we”, “us” or “our” means The Route Holidays.
- “Guest”, “Customer”, “you” or “your” means the person making an enquiry, booking or travelling under a booking.
- “Service Provider” means an independent hotel, vehicle owner, driver, transport operator, restaurant, guide, activity provider or other third-party supplier whose services may be arranged as part of a booking.
By accepting a quotation, making a payment, confirming a booking through WhatsApp, email, phone or other written/electronic communication, the Guest acknowledges that they have read and accepted these Terms & Conditions and the policies applicable to their booking.
2 Enquiry and Booking
- All bookings are subject to availability.
- An enquiry, quotation or tentative itinerary does not constitute a confirmed booking.
- A booking shall be treated as confirmed only after receipt of the required payment and confirmation from The Route Holidays.
- The Guest is responsible for checking the travel dates, number of guests, hotel category, transportation, inclusions, exclusions and other booking details before making payment.
- The final written quotation, itinerary, invoice or booking confirmation shall govern the specific services booked.
- Booking-related information communicated and accepted through WhatsApp, email or other written/electronic communication may form part of the booking record.
- Verbal discussions shall not override the final written booking confirmation unless subsequently confirmed in writing.
3 Payment
- Advance payment may be required to block hotel rooms, transportation and other services.
- The balance amount shall be payable according to the payment schedule communicated at the time of booking.
- Until the required payment is received, availability and applicable prices are not guaranteed.
- Failure to make the balance payment within the specified period may result in release or cancellation of pending arrangements.
- Any additional service requested after confirmation shall be charged separately.
4 Package Inclusions and Exclusions
Only services specifically mentioned as included in the confirmed quotation or itinerary shall form part of the package.
Unless specifically included, the following may be payable separately:
- parking;
- toll charges;
- entry tickets;
- special/VIP darshan;
- pooja charges;
- guide charges;
- local e-rickshaw/battery vehicle;
- boating;
- ropeway;
- additional kilometres;
- additional waiting;
- route changes;
- additional sightseeing;
- additional meals;
- room upgrades;
- personal expenses;
- shopping;
- laundry;
- room service;
- damages;
- and other incidental expenses.
5 Hotel Accommodation
- Hotel accommodation shall be provided according to the category and occupancy mentioned in the confirmed booking.
- A specific hotel is not guaranteed unless its name has been expressly confirmed in writing.
- Room allocation is subject to hotel availability and hotel policy.
- Specific room number, floor, view, bed configuration, connecting rooms or adjacent rooms cannot be guaranteed unless expressly confirmed.
- Early check-in and late check-out are subject to availability and may involve additional charges.
- Extra beds or mattresses are subject to hotel policy and availability.
- Guests must comply with the hotel’s identification, security deposit, visitor and other applicable requirements.
- Damage caused to hotel property by a Guest shall be payable by the Guest directly to the hotel.
- Hotel facilities and services are subject to the hotel’s operational conditions.
6 Power Supply and Hotel Facilities
Where a hotel provides generator or inverter backup, the capacity and operation of such backup shall depend on the hotel’s system.
During power interruptions, operation of AC, geyser, television, lift, Wi-Fi or other electrical facilities may be affected depending on available backup capacity.
7 Meals
- Meals are included only when specifically mentioned in the confirmed package.
- Meal timings, menu, restaurant arrangements and serving conditions are subject to the relevant hotel/restaurant.
- Special dietary requirements should be communicated in advance and remain subject to availability.
- Unused or missed meals due to personal choice, late arrival, early departure or sightseeing shall ordinarily not be refundable or adjustable.
8 Transportation
- Transportation may be arranged through independent third-party vehicle owners/operators.
- The vehicle category shall be based on the confirmed booking and passenger count.
- A particular vehicle, registration number, colour or driver is not guaranteed unless expressly confirmed in writing.
- Vehicle usage is limited to the confirmed itinerary.
- Additional sightseeing, route deviations, additional kilometres, additional trips or waiting time requested by the Guest may attract additional charges.
- AC operation may be affected by weather, road conditions, technical conditions or applicable transport requirements.
- In the event of vehicle breakdown or operational failure, The Route Holidays shall make reasonable efforts to arrange suitable alternative transportation, subject to availability.
- Reasonable delays caused by traffic, road conditions, local restrictions, weather, security arrangements or circumstances beyond reasonable control shall not automatically constitute a failure of service.
9 Independent Third-Party Service Providers
The Route Holidays may arrange services through independent third-party service providers, including hotels, vehicle owners, drivers, transport operators, restaurants, guides and activity providers.
Such providers remain responsible for their respective services and their applicable licences, permits, insurance, personnel, vehicles, premises and statutory obligations.
The Route Holidays acts as a travel facilitator/coordinator for such independently operated services and does not own or directly operate every vehicle, hotel or service included in a package.
However, The Route Holidays remains responsible for services or obligations that it itself undertakes to provide and for any liability imposed upon it under applicable law.
10 Transportation Accident, Injury or Death
Where transportation is provided through an independent third-party vehicle owner/operator, any accident-related claim involving injury, death or property damage shall be determined according to applicable law, the facts of the incident, the responsible parties and the relevant insurance policy.
Depending on the circumstances, a claim may involve the driver, vehicle owner/operator, insurer and/or other legally responsible party.
The Route Holidays shall not be responsible for the independent negligence, misconduct, driving conduct, mechanical failure or other acts or omissions of an independent third-party transportation provider, except to the extent liability is imposed upon The Route Holidays under applicable law.
Nothing in these Terms is intended to exclude or restrict any liability, compensation, right or remedy that cannot legally be excluded or restricted.
Guests shall cooperate with the driver, vehicle owner/operator, police, medical authorities and insurer where reasonably required following an accident.
11 Vehicle and Driver Documentation
The Route Holidays may require third-party transportation providers to provide appropriate vehicle and driver documentation before arranging transportation, as reasonably required for the service.
The vehicle owner/operator remains responsible for maintaining the vehicle and complying with applicable requirements relating to registration, permit, fitness, insurance and driver licensing.
12 Sightseeing and Temple Visits
- Sightseeing shall be provided according to the confirmed itinerary and available time.
- Temple darshan is subject to temple timings, crowd conditions, security arrangements, local administration, festivals and other local circumstances.
- The Route Holidays does not guarantee a specific darshan time unless expressly confirmed in writing.
- VIP/special darshan, pooja, entry tickets, guide charges and local transportation are included only where specifically mentioned.
- Guests must follow temple, religious-place, security and local authority rules.
13 Itinerary Modification
The sequence of sightseeing and timings may be rearranged where reasonably necessary due to:
- traffic;
- weather;
- road conditions;
- temple timings;
- crowd conditions;
- local restrictions;
- government directions;
- security requirements;
- vehicle restrictions;
- operational requirements.
A reasonable rearrangement of the itinerary shall not by itself constitute cancellation of the package.
Guest-requested changes after confirmation may result in additional charges and are subject to availability.
14 Force Majeure
The Route Holidays shall not be responsible for delay, interruption or modification of services caused by circumstances beyond its reasonable control, including:
- natural disasters;
- floods;
- heavy rainfall;
- earthquakes;
- landslides;
- extreme weather;
- roadblocks;
- strikes;
- riots;
- civil disturbance;
- government restrictions;
- temple closures;
- accidents;
- transportation disruption;
- public-health emergencies;
- acts of God;
- or other unforeseen events.
The Route Holidays shall make reasonable efforts to assist the Guest where practicable.
Additional expenses arising from such circumstances shall ordinarily be borne by the Guest unless otherwise required by applicable law or specifically agreed by The Route Holidays.
1.15 Guest Responsibilities
Guests shall:
- provide accurate booking information;
- carry valid government-issued identification;
- follow hotel rules;
- follow driver and transport safety instructions;
- comply with temple and local authority rules;
- maintain appropriate conduct;
- take reasonable care of personal belongings;
- pay applicable additional charges;
- disclose relevant requirements that are necessary for arranging the booking.
Any additional expense caused by incorrect information, misconduct, failure to follow instructions or violation of applicable rules may be payable by the Guest.
16 Personal Belongings
Guests are responsible for their luggage, cash, jewellery, electronics, documents and other personal belongings.
The Route Holidays shall not be responsible for loss, theft, misplacement or damage to personal belongings where such loss is outside the Company’s direct control or is caused by a third party.
This clause does not exclude liability that cannot legally be excluded.
17 Children and Infants
Child and infant charges, accommodation, meals, extra beds/mattresses and transportation requirements shall be determined according to the applicable hotel/service-provider policy and the confirmed booking.
18 Special Requests
Requests relating to:
- particular hotel;
- specific room;
- floor;
- room view;
- bed type;
- connecting rooms;
- early check-in;
- late check-out;
- specific vehicle;
- specific driver;
- special meals;
are subject to availability unless expressly guaranteed in writing.
19 Medical Responsibility
Guests are responsible for considering their own health, fitness and suitability for travel.
The Route Holidays is not a medical service provider and does not provide medical treatment or medical advice.
Medical treatment, hospitalisation, medicines and related expenses shall ordinarily be the Guest’s responsibility, subject to applicable insurance coverage and applicable law.
20 Travel Insurance
Guests are strongly advised to obtain suitable travel, medical, personal accident and baggage insurance.
The Route Holidays does not automatically provide insurance unless specifically stated in the booking confirmation.
Insurance claims are governed by the terms and conditions of the relevant insurer.
21 Third-Party Service Failure
If an independent service provider fails, delays, changes or cancels a service, The Route Holidays shall make reasonable efforts to communicate with the provider and, where practicable, assist the Guest with an alternative arrangement.
Where the failure is attributable solely to an independent provider, The Route Holidays shall not automatically be treated as responsible for the provider’s independent act or omission, subject to applicable consumer law and the specific contractual obligations undertaken by The Route Holidays.
22 Company Cancellation or Failure to Provide Confirmed Services
If The Route Holidays cancels a confirmed booking for reasons within its reasonable control and is unable to provide the confirmed services or a reasonably comparable alternative acceptable to the Guest, The Route Holidays shall provide an appropriate refund of amounts actually received for the affected services, subject to any lawful deductions or amounts already paid to third-party suppliers that are genuinely non-recoverable and disclosed to the Guest.
Where only part of the package is affected, the remedy shall ordinarily relate to the affected portion rather than automatically to the entire package.
This clause does not apply in the same manner to force-majeure situations, where remedies may depend upon the circumstances, supplier terms and applicable law.
23 Limitation of Liability
To the maximum extent permitted by applicable law, The Route Holidays shall not be liable for indirect, incidental, special or consequential losses arising solely from third-party services or circumstances beyond its reasonable control.
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- wilful misconduct;
- liability imposed by applicable law;
- or any other liability that cannot legally be excluded or limited.
24 Intellectual Property
Website text, graphics, photographs, logos, branding, designs and other original content belonging to The Route Holidays may not be copied, reproduced, modified, distributed or commercially used without prior written permission, except where permitted by law.
25 Website Information
Website photographs and descriptions are intended to provide general information and may not represent the exact room, vehicle or facility allocated to a particular Guest.
The confirmed booking documents shall prevail over general website descriptions for the particular booking.
26 Complaints
Guests are encouraged to contact The Route Holidays as soon as reasonably possible if they experience an issue during the tour so that reasonable efforts can be made to resolve it.
The internal complaint process does not remove any statutory rights or remedies available to the Guest.
27 Governing Law and Jurisdiction
These Terms shall be governed by the laws applicable in India.
The parties shall first attempt to resolve contractual disputes amicably.
Subject to applicable law and the jurisdiction of any statutory authority, tribunal, consumer commission or other forum that cannot legally be excluded, courts having competent territorial jurisdiction at Mathura, Uttar Pradesh shall have jurisdiction over contractual disputes concerning The Route Holidays.
This clause does not seek to remove any mandatory statutory right or remedy available to a consumer.
28 Changes to Terms
The Route Holidays may update these Terms from time to time.
For an already confirmed booking, the version communicated or accepted at the time of booking shall ordinarily apply, except where changes are required by applicable law.
